These Terms of Service (the "Terms") govern the contractual relationship between Szirtes Dániel egyéni vállalkozó (registered seat: 1116 Budapest, Tó utca 14., Hungary, tax ID: 69538711-2-43; the "Provider") and users of the VocaUp mobile application (the "User"). The Terms are based on Hungarian law — in particular the Civil Code (Act V of 2013), Government Decree 45/2014. (II. 26.) on the detailed rules of consumer-business contracts, and Act CVIII of 2001 on electronic commerce services (Eker. tv.) — and on EU consumer-protection rules (Directive 2011/83/EU).

Service: VocaUp is an AI-powered mobile application that generates interactive learning tasks (quiz, true/false, matching, sorting, fill-in-the-blank, definition, flashcard) from text, images and documents uploaded by the User. The service is available on Android (Google Play) and iOS (Apple App Store).
The contract entered into under these Terms covers the use of the VocaUp application, including free and paid (Premium) features.
Free features: Limited number of task generations per day in exchange for viewing ads, limited OCR/image processing, basic language set.
Premium features: Ad-free usage, higher generation limit, advanced AI models, unlimited flashcard storage, statistics.
The contract between the User and the Provider is formed as follows:
By accepting these Terms, the User expressly acknowledges that payment and refund flows are governed by Google's and Apple's store rules.
Current subscription plans and prices are shown in the app and on the Google Play / Apple App Store listings. Prices are stated in the local currency of the platform and region, and include VAT (or local sales tax) as applicable.
The Premium subscription renews automatically at the end of each period unless the User cancels at least 24 hours before renewal through their Google Play or Apple App Store settings.
The sales invoice is issued by Google LLC or Apple Inc. The Provider does not issue invoices directly for in-app purchases.
Under EU Directive 2011/83/EU and Hungarian Government Decree 45/2014. (II. 26.), Consumers (private users in the EU/EEA) have the right to withdraw from the subscription without giving any reason within 14 days of the purchase.
The User may declare withdrawal:
The Provider will arrange the refund within 14 days of receiving the withdrawal notice. Because the subscription is processed by Google Play or the Apple App Store, the refund must technically be initiated by the User in the store interface (Apple: "Report a Problem"; Google: "Refund Request"). The Provider does not have direct access to the transaction records and cannot reverse the charge directly — the User submits the request to Google / Apple, supported by the Provider's confirmation.
The right of withdrawal does NOT apply where the Provider has, with the User's express prior consent given through a checkbox in the app, started performance of the service before the 14-day period has expired. Where no such consent was given, the right of withdrawal applies in full.
The User can submit complaints by e-mail to info@vocaup.com. The Provider will substantively review and respond to the complaint within 30 days.
If the complaint is not resolved to the User's satisfaction, the following remedies are available:
The Provider takes all reasonable steps to ensure service continuity but does not warrant uninterrupted or error-free operation.
AI content disclaimer: VocaUp uses artificial intelligence (AI) to generate learning materials and tasks. AI-generated content may contain inaccuracies, factual errors or incorrect translations. The Provider does not accept liability for the correctness of AI-generated content, nor for the User's academic or examination results.
For consumer Users in the EU/EEA, the foregoing liability limitation does NOT apply to: (a) wilful misconduct or gross negligence; (b) personal injury or death; (c) breach of a cardinal contractual obligation (the proper performance of which the User reasonably relied on); (d) liability under Directive 85/374/EEC on product liability; (e) any liability that cannot be excluded under mandatory consumer law.
AI obligation: The User expressly acknowledges sole responsibility for independently verifying any AI-generated content before relying on it for educational, professional, examination or any other consequential purpose. No claim against the Provider may be based on a failure to perform such verification.
The Provider's liability is limited to the broadest extent permitted by applicable law. Limitation does not apply to wilful misconduct or gross negligence.
The Provider may amend these Terms unilaterally. Users will be notified at least 30 days before material changes take effect (and at least 15 days for non-material changes), via in-app messaging and/or e-mail. Users who do not accept the amendment may terminate the contract before the new terms take effect.
These Terms and the contract between the Provider and the User are governed by Hungarian law. Mandatory EU consumer-protection rules (GDPR, 2011/83/EU, etc.) apply to all users in the EU/EEA. Disputes — consumers before the court of their place of residence; otherwise the Budapest II–III District Court — fall under exclusive jurisdiction as set out above.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

The Provider respects the intellectual property rights of others. If you believe that any content generated or available within the VocaUp application infringes your copyright, please send a detailed notification to info@vocaup.com, including:
The Provider will investigate all copyright infringement notifications within 30 days and, if justified, will remove the infringing content or disable access to the infringing account.
VocaUp is classified as a limited-risk AI system under EU Regulation 2024/1689 ("AI Act"). The User acknowledges that: (a) the content (questions, answers, definitions, etc.) is generated by AI — explicit transparency per Art. 50; (b) no automated decisions are made about the User's eligibility, identity or rights (Art. 22 GDPR); (c) the Provider maintains regular human oversight of the content-generation process and reserves the right to audit the AI output quality.
US state-level age verification: Where US state laws (e.g. Texas SB 2420, Florida HB 3, Utah Social Media Regulation Act, similar) require age verification or parental consent for minors, VocaUp limits use to Users aged 13 and above. Users aged 13–17 in jurisdictions that require it must obtain parental consent before activating a paid subscription. The Provider relies on the App Store / Google Play age-rating signals and the User's self-declaration.
